DEFINITIONS
Client – Client means the party named and described as the “client” on the Pop-up Society Booking Form, or such person or organization as may be substituted with the written consent of Pop-up Society.
GENERAL DISCLAIMER
You expressly understand and agree that:
(a) Pop-up Society and any of their affiliates provide services on an “as is” and “as available” basis and that Pop-up Society makes no warranties, representations or conditions of any kind, whether express or implied, including but not limited to; implied warranties of merchantability, fitness for a particular purpose and non-infringement and that any such warranties are hereby expressly disclaimed, and
(b) Pop-up Society specifically makes no warranties that it or any of its services, including any content, information, products or services obtained from or through the use of Pop-up Society or any of the services including this website, will be provided on an uninterrupted, timely, secure or error-free basis or that such services or the results derived therefrom will meet your requirements or expectations.
TICKET TERMS AND CONDITIONS
Pop-up Society is acting as Promoters and Organisers of any event advertised on this website unless otherwise specified.
Pop-up Society reserves the right to:
• make reasonably necessary alterations to the advertised event arrangements, featured participants or programme
• cancel or abandon any event without notice and without liability for compensation or damage other than up to a maximum of the ticket price (if an event cancels in advance we will make reasonable attempts to contact you using the details you have provided)
• restrict ticket sales to a maximum number per person and/or company/organization and cancel any tickets purchased in excess of this.
The particular venue reserves the right to:
Tickets cannot be refunded unless an event is cancelled or rescheduled so please check your tickets carefully on receipt and contact us immediately if you have any queries. We are not liable for lost, destroyed or stolen tickets and cannot replace them under any circumstance.
Tickets are not transferable and their resale for profit or commercial gain (except by us or our authorised sub-agents) or use in promotions or packages without the express permission of Pop-up Society is prohibited and may render them void
You must produce a valid ticket to attend the event and removing parts of, defacing or otherwise altering your ticket in any way may render it void
If you experience any problems with your seating or enjoyment prior to or during the event please inform venue staff immediately as issues cannot always be resolved after the event. Please note loud music or noise can damage hearing
By attending the event you consent to being filmed / recorded as part of the audience for security and broadcast without payment.
LIMITATION OF LIABILITY
You expressly understand and agree that in no event shall this site, including its affiliates, sponsors and/or licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether this site had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with:
(a) the use, inability to use or performance of any of the services of this site, or
(b) any unauthorized access to or modification to any of your content or transmissions, or
(c) any other matter relating to this site or any of the services.
We attempt to ensure that the information available on the web site at any one time is accurate. However, we cannot guarantee that it will be fault free and we cannot be responsible for goods and services offered by us as agents for third parties or for any aspect of the relationship between you and that third party.
We do not accept liability for any errors and/or omissions and reserve the right to change any of the information found at this site at any time without notice.
We do not accept liability for any indirect or consequential loss arising out of the use of or the inability to use the website or for any products or services purchased from the website whatsoever.
Pop-up Society will only be liable for direct loss up to a maximum total of the price of the product or service purchased after extensive investigation. This liability section only applies to the extent permitted by law.
JURISDICTION
Every purchase you make shall be deemed performed in South Africa unless otherwise stated.
South African law shall govern every aspect of contractual agreement concerning purchases made from Pop-up Society.
These terms contain the entire agreement between you and Pop-up Society relating to your purchase.
The invalidity or enforceability of any term shall not affect the validity or enforceability of any of the other terms.
USE OF THIS WEBSITE
You undertake that all details you provide to us for the purpose of booking, ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service. If there are any changes to the details supplied by you it is your responsibility to inform us. Confirmation of receipt of your order by e-mail, does not guarantee the ticket sale. Credit card sales will be encrypted.
SAFETY AND ENJOYMENT
In accordance with South African legislation, it is an offence to smoke in all enclosed public spaces.
Pets are not permitted on certain premises, with the exception of assistance dogs.
Please take care of all personal property brought onto the premises.
AGREEMENT
A binding agreement between Pop-up Society and the Client is effective upon meeting the payment terms as required.
Bookings are subject to the availability of the requested facility and will not be reserved or confirmed until receipt of full payment is received in accordance with these Terms & Conditions.
No cancellation or termination of the agreement by the Client will be accepted by Pop-up Society after a completed payment has been received, and Pop-up Society will not issue any refund for any part or full payment under any circumstance.
BOOKINGS AND PAYMENT
All bookings for tickets can be done via the Computicket website or directly through one of the Pop-up Society contacts. One can also visit the restaurant situated on 132 Helen Joseph Road for payment and collection.
A ticket booking is only confirmed upon receipt of payment.
All prices quoted on Computicket are based on the information provided by Pop-up Society. Alterations to the details of the Event may occur.
Catering and Beverages for any event must be consumed within the timeframe as stipulated by Pop-up Society
Pop-up Society accepts no responsibility for late arrivals and the Ticket duration may not be extended beyond the stipulated time under any circumstances.
DISPLAY OF TICKETS
Correct ticketing must be presented upon arrival. Failure to comply will result in entry being refused.
ON SELLING
The on selling of tickets for gain is not permitted. Clients are not permitted to sell or on sell for gain any part of their private marquee and room facilities, including the catering package. Any form of advertising or promoting of such is deemed to be on selling. Any Client who offers to on sell or is deemed to be on selling for gain will have their booking cancelled.
Clients are entitled to share the cost of entertainment with their guests, however if the Client is operating their facility to earn a profit, they are deemed to be on selling.
GENERAL
All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law.
Under no circumstances will Pop-up Society be liable to the Client if Pop-up Society is unable to perform its obligations to the Client due to any event or cause of force majeure being any event or act beyond the control of Pop-up Society.
